Terms of Service

Welcome to Skipper24! An application provided by Baltic Trade GmbH (“Company,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) govern your access and use of the Skipper24 mobile application (“App”). By accessing or using the App, you agree to comply with these Terms.

1. Accounts

1.1 Eligibility: Users must be at least 18 years old to create an account and use the App. By creating an account, you represent and warrant that you meet this requirement.

1.2 Account Creation: To access certain features of the App, you must create an account. Provide accurate and complete information and promptly update any changes to keep your information current.

1.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

2. User Content

2.1 Content Creation and Upload: Users can create and upload content such as text and images (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, sublicensable, and transferable right to use, reproduce, modify, distribute, and display such content in connection with the App.

2.2 Content Restrictions: User Content must not:

• Infringe any third-party intellectual property rights.
• Contain defamatory, obscene, offensive, or unlawful material.
• Violate any laws or regulations.
• Impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.

2.3 Responsibility: You are solely responsible for the User Content you upload and any consequences arising from its use.

3. Intellectual Property Infringement

3.1 DMCA Compliance: If you believe your copyright-protected work has been infringed in the App, please contact our Copyright Agent at info@skipper24.com with the required information as specified by the Digital Millennium Copyright Act (DMCA).

4. In-App Purchases and Subscriptions

4.1 In-App Purchases: The App offers in-app purchases. All in-app purchases are final and non-refundable, except as required by applicable law.

4.2 Subscription Plans: We offer subscription plans that may include a free trial period. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

4.3 Billing: Any payment information provided must be accurate, and you authorize us to charge the applicable fees to your payment method. If payment fails, we may suspend or terminate your access to paid features.

5. Proprietary Rights

5.1 Ownership: All content and materials in the App, including logos, visual designs, and trademarks, are the exclusive property of Baltic Trade GmbH.

5.2 Feedback: If you provide feedback, suggestions, or ideas regarding the App, you grant us the right to use them without any obligation to compensate or credit you.

6. User Conduct

6.1 Prohibited Activities: Users must not:

• Use the App for any unlawful purposes.
• Interfere with the App’s operation or other users’ enjoyment of the App.
• Attempt to gain unauthorized access to any portion of the App or any other systems or networks.

7. Limitation of Liability

7.1 Disclaimer of Warranties: The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

7.2 Limitation of Liability: To the fullest extent permitted by applicable law, Baltic Trade GmbH will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the App.

8. General Terms

8.1 Modification of Terms: We reserve the right to modify these Terms at any time. We will provide notice of any changes through the App or by other appropriate means. Your continued use of the App after such notice signifies your acceptance of the modified Terms.

8.2 Termination: We may terminate or suspend your account and access to the App at our sole discretion, without prior notice or liability, if you breach these Terms.

8.3 Governing Law: These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any legal actions or proceedings arising out of or related to these Terms will be brought exclusively in the courts located in Ratekau, Germany.
